These Terms of Service ("Terms") govern your use of the At the Atelier platform, operated by Evermore Jewellery Private Limited ("Company", "we", "us"). They also govern the goods and services you buy from us.
1. Acceptance
By accessing or using this website or any associated service, you agree to be bound by these Terms. If you do not agree, do not use the platform.
2. What we provide
At the Atelier provides three things to retail jewellers:
- The Digital Ring Builder — a software-as-a-service ring configurator with real-time customisation, augmented-reality try-on and a branded storefront.
- The Prototypes Kit — an optional physical set of sample ring prototypes.
- Custom ring manufacturing — a made-to-order service that manufactures a designed ring and ships it to you.
3. Eligibility
The service is for registered businesses, ordinarily retail jewellers. By subscribing or ordering, you represent that you are authorised to enter into agreements on behalf of your business and that you are acting in the course of that business. We do not contract with consumers.
4. Account and subscription
- You are responsible for keeping your account credentials confidential and for everything done under your account.
- The Digital Ring Builder subscription is billed at the rate published on our pricing page, in advance, for each billing period.
- Every new account starts with a free trial of 30 days. We charge nothing during the trial.
- The trial and the paid subscription renew automatically until you cancel. We send an email and an in-app notification 7, 3 and 1 days before every renewal, each carrying a cancellation link.
- You may cancel at any time. Access continues to the end of the period you have paid for.
- After a cancellation expires, your access to the admin panel ends and the ring builder on your storefront shows a neutral "work in progress" state to your customers. If an account stays cancelled for more than 60 days, we remove the widget from your storefront.
- All fees are in United States Dollars unless we state otherwise.
The Trial & Subscription Policy sets out these terms in full and forms part of this agreement.
5. The Prototypes Kit
- The Kit is a one-time purchase, shipped to your registered business address.
- The pieces are non-precious sample prototypes. They are demonstration tools and they are not for resale.
- A Kit purchase includes order credit as described on our pricing page. Credit is non-transferable, is not exchangeable for cash, and needs an active subscription to use.
- Delivery terms are in the Shipping & Delivery Policy.
6. Custom ring orders
- Each ring is made to order against the specification frozen in the order.
- We quote each order in your dashboard. A quotation is valid for the period shown on it.
- An order is confirmed when you pay our price through our payment gateway. That payment places a hold on the specific diamond for your order.
- Our production team then reviews and accepts the order, normally within 1 business day. Production starts on our acceptance and normally takes 4 weeks.
- You may cancel at no cost between your payment and our acceptance. After our acceptance the order cannot be cancelled, changed or refunded.
- If we cannot fulfil an order, we cancel it and refund your payment in full.
- We ship to your registered business address. We never ship to, invoice or contact your end consumer.
The full flow is described on the Custom ring orders page.
7. Payment and tax
- Our payment gateway partners process every payment. We do not store your card details.
- Goods and Services Tax and any other applicable tax is added at checkout and itemised on the invoice.
- We issue a tax invoice for every payment, available in your dashboard.
- If a payment fails, we may retry it and we may suspend the service until the amount is paid.
- We may change published prices on at least 30 days' notice. A change never affects a period you have already paid for.
8. Refunds and cancellation
Our Refund & Cancellation Policy sets out what is refundable, the cancellation windows and the time a refund takes. It forms part of this agreement.
9. Your brand and your content
You retain ownership of your logo, your branding and any content you upload. You grant us a limited licence to display your branding inside the platform for the sole purpose of delivering the service to you. We do not use your branding for our own marketing without your written permission.
10. Your relationship with your customers
You sell to your end consumer under your own brand, at your own retail price and on your own terms. You are responsible for your own consumer-facing terms, your own after-sales service and your own compliance with the consumer law that applies to you. We are not a party to the contract between you and your customer.
11. Acceptable use
You agree not to reverse-engineer the platform, use it for an unlawful purpose, resell access without our authorisation, misrepresent our goods, or interfere with the operation of the service.
12. Intellectual property
All platform code, design, three-dimensional models and technology remain the exclusive property of Evermore Jewellery Private Limited. Your subscription grants a non-exclusive, non-transferable licence to use the service for the term of the subscription.
13. Service availability
We work to keep the platform available at all times, but we do not guarantee uninterrupted service. We may carry out maintenance and we give notice of planned maintenance where we reasonably can. We are not liable for an interruption caused by an event outside our reasonable control.
14. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the service shall not exceed the fees you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental or consequential damages, including lost profit or lost sales.
15. Indemnification
You agree to indemnify and hold us harmless from any claim arising from your use of the platform, from your sale to your end consumer, or from your violation of these Terms.
16. Termination
We may suspend or terminate your access if you breach these Terms. On termination for breach your right to use the platform ceases immediately and no refund is issued. You may terminate at any time by cancelling your subscription.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
18. Changes
We may modify these Terms. We post the change on this page with an updated date and, for a material change, we notify you by email. Continued use after a change constitutes acceptance.
